TikTok and its parent company ByteDance are under fresh scrutiny from US regulators, as the Federal Trade Commission (FTC) has referred a complaint to the Department of Justice (DOJ) over potential violations of children’s privacy laws.
The FTC’s investigation, prompted by concerns under the Children’s Online Privacy Protection Act (COPPA) and the FTC Act, has found grounds to believe that TikTok and ByteDance may be violating existing regulations. These laws govern the collection, use, and disclosure of personal information from children under 13 years old and prohibit “unfair or deceptive acts or practices” by companies.
In response to the referral, a TikTok spokesperson expressed disappointment, stating the company disagreed with the allegations. They highlighted ongoing efforts to collaborate with the FTC for over a year to address concerns, emphasizing their preference for continued dialogue over litigation.
The FTC’s decision to refer the case to the DOJ marks a significant escalation in regulatory pressure on TikTok, separate from previous legislative actions aimed at potentially banning the app in the US unless ByteDance sells its American operations by 2025. This move follows earlier allegations that TikTok could potentially share user data with Chinese authorities, which the company vehemently denies.
President Joe Biden signed legislation in April targeting these concerns, prompting TikTok to file a lawsuit challenging the law’s constitutionality, arguing it infringes on free speech rights and impacts its vast American user base.
The DOJ has confirmed consultation with the FTC regarding the referral but refrained from commenting on specifics, maintaining standard procedural confidentiality.
